Terms and Conditions

1) The Club

The club shall be called Whoop Hall Country Club and shall be a proprietary club owned by Whoop Hall Ltd. (the owner), located at The Whoop Hall Kirkby Lonsdale, LA6 2GY, and administrated by the Manager of the Club (‘the Manager’) or by such persons as the owner shall nominate. The clubs opening hours are determined by the management from time to time.

2) Membership

i) Persons wishing to become Members of the Club shall complete the official application form, included in this pack and submit the form to the Club manager. Further application forms may be obtained from the Club reception. Each application form must be accompanied by the relevant joining fee payment, which is at the time in force, and appropriate annual subscription or direct debit mandate for monthly payment of annual fee.

ii) Absolute discretion is granted to the Owner and the Manager to reject any application or renewal for membership without ascribing any reason for doing so, in such case any monies sent will be immediately returned.

iii) On acceptance of an application, the applicant will be sent a Membership card, which will remain the property of the Owner and up on termination of membership for whatever reason will be returnable to the Owner on demand. A fee of £5.00 will be charged to replace lost cards.

iv) Membership is non-transferable from person to person. One membership unit allows entry for one registered (or named) member - two membership units allows two registered members entry

v) Temporary membership is offered to hotel guests during their stay in the Hotel on the basis of a one membership unit per room.

vi) Full Membership to the club entitles members to unlimited use of the swimming pool, gym, Jacuzzi, steam room and sauna, together with changing rooms. However we stipulate that members have a 15 minute allowance in the steam room , sauna and jacuzzi in one session (for your own safety).

vii) Off Peak membership entitles members to use of the same facilities as full membership, but is restricted to the hours 9.30am – 5.00pm Mon-Sat and 9.30 – 7.00pm Sun.

Additional Services – The opportunities for other treatments do not form part of the Membership and will be subject to additional charge.

3) Subscription

i) The membership year of the club shall run for such period of 12 months as the owner may determine. The Owner may introduce an entry fee, which may vary at the Clubs/ Managers’ discretion.

ii) The entry fee, annual subscription and charges for individual facilities shall be such amounts the Owner in its sole discretion shall determine from time to time.

iii) Membership of the Club shall commence from the day of acceptance following receipt of subscription.

iv) Membership shall be renewed annually by payment to the club of an annual subscription fee, on or before the expiry date.

v) When paying by cash, cheque, Access or Visa, one payment for the whole year is required. Please note that if paying by direct debit, taken as twelve monthly payments. If any payment is missed or cancelled membership is withdrawn 14 days after missed payment and you are no longer entitled to use any of the facilities, regardless of the number of payments paid previously.

4) Club Facilities & Usage

Experienced staff are available to design individual exercise schedules, demonstrate and supervise correct use of the training equipment. Persons under 16 years of age are permitted to use some of the facilities when accompanied by an adult who shall at all times be responsible for the person’s conduct. Children under 16 years may not use the Gym, sauna or steam room (for their own safety). Children are allowed in the Club from 8.00 am until 6.30pm in the week and 9.00 am until 6.30pm at weekends.

i) Members and their guests are particularly advised not to undertake strenuous physical activity for which they might be medically unfit and the Owner and Manager will not be in any way responsible for any harm which may come to a member or guest as a result of their undertaking within the Club, any activity which is beyond their physical capacity. Members and guests are advised to have a Lifestyle consultation before commencing exercise. Those declining a consultation must sign a disclaimer before using the Gymnasium.

ii) Members should not use the facilities of the Club where under the influence of alcohol, antihistamines, vasoconstrictors, narcotics or tranquillisers. Those with diabetes, heart disease , high/low blood pressure or any other serious medical condition should check with their doctor that it is safe for them to use the Clubs facilities. Members should inform club management of any significant medical conditions.

iii) Members and their guests should be suitably attired whilst using the facilities. Trainers should be worn at all times in the Gymnasium, Only persons wearing swim costumes will be permitted in the pool area.

iv) Steam room, sauna and Jacuzzi users should read the written instructions and comply with them at all times. The Owner shall not be liable for the consequences of any such failing to follow such instructions and shall be entitled to remove from the Club any such person.

v) Babies and Toddlers are permitted in the pool, provided they are accompanied & supervised at all times and providing they wear suitable waterproof nappies or pants.

vi) All persons must shower before entering the pool and in between using the sauna, steam room & Jacuzzi.

vii) Towels are not provided for members, however hotel guests are able to exchange their room key for a towel upon arrival at the Country Club. Towels will be available at a small charge to members.

vii) No food or alcohol is to be consumed on the Country Club premises and the use of drinking glasses is not permitted within the club. The Whoop Hall Country Club constitutes a no smoking area.

ix) The owners reserve the right to restrict the number of Members using the facilities at any one time.

x) In the interest of safety, running , jumping, diving , ball games and the throwing of any objects are strictly not permitted in the pool area nor are the use of snorkels, flippers and inflatables. Please be advised that there is no lifeguard.

xi) The pool has a limited capacity of 50 bathers at any one time, please respect the needs of other members. The Management reserves the right to determine a reasonable period of bathing at any one time to allow members the opportunity to use the pool facility.

xii) All activity classes are provided in addition to your membership and are free of charge unless we have to bring in an outside instructor. As a courtesy the hotel allows us to use their function room for our non pool based classes. There will be occasions when this room is not available and we will endeavour to give members prior notice of this.

xii). The Club will not be responsible for any damage caused by pool chemicals to jewellery and asks patrons to remove all jewellery before using the pool and spa.

xiii) There is no set legal limit but standard accepted practice sets an age limit of under eight to be in a changing room of the opposite gender. If patrons are unhappy with this they are welcome to use the disabled changing facilities together.

5) Club Admission

i) On entering the Club, members must swipe their membership card at the reception desk. All guests must be accompanied by a member and must sign in the guest book.

ii) Except with the prior consent of the Manager, no member shall at any time introduce any guest who has been rejected as a member or had membership terminated or suspended.

iii) A member introducing a guest shall be responsible for the good conduct of such guests whilst on Club premises and shall ensure that such guests comply with the Rules of the Club. A member shall not leave the club premises before his guest.

iv) Each member shall be entitled to be accompanied by no more than two guests and shall be responsible for payment of the appropriate guest fee (specified by the owner) for such guests use of the facilities. Members are entitled to bring a guest to the Club a maximum of four times a year.

6) Opening Times

The times at which any or all of the facilities shall be available to members and guests shall be at the discretion of the Owner or the Manager. Any or all of the facilities may be closed at any time for the purpose of cleaning, decorating, repairs events or special functions.

7) Owners Liability

The Owner and its employees will not be liable in any way for the loss of, or damage to, the property of members or guests or for the personal injury or death arising from the wilful act, neglect or default of the Owner or any of its employees or agents.

8) Security

No responsibility can be accepted for the loss of any items in the Country Club, or the car park. Members are advised not to bring valuables for their own security.

9) Fire

Members are asked to acquaint themselves with the fire exits, Signed around the building.

10) Suspension of membership

Membership can be suspended but only in special circumstances e.g. pregnancy, serious injury, hospitalisation etc… Notification of such circumstances must be given in writing to the manager as soon as possible. Memberships can be suspended for a minimum of three months and a maximum of twelve months.

11) Termination of membership

To terminate your membership you must give notice in writing to the manager at least 30 days in advance. You must also cancel your direct debit at the bank directly to ensure money is not deducted. (The management cannot be held responsible for subsequent payments that are processed due to failure of the member to cancel their debit at the bank).

Annual memberships and joining fees are not returnable.

12) Closing the Club

The owner shall have the power and right at any time upon one month’s notice to discontinue the club upon refunding to the members unexpired portion of their current subscription.

13) Compliance with the Rules

By their membership Members accept and agree to be bound by the rules of the club from time to time in force. Any failure to adhere to the club rules or reasonable staff requests may result in you being excluded from the facilities. There is an intention to develop Club activities within the Club, this may from time to time involve aqua aerobics and the need to section off part of the pool, during peak times.

The Owner in its sole discretion may at any time vary these rules or any entry fee or membership subscription or any of the charges for the use of any or all of the facilities. Notice of such variations shall be given to members by exhibition thereof on the Clubs notice board. Members will further comply with any direction which the manager may give to ensure the smooth operation of the Club, the use of the facilities and the convenience of the members.

Any dispute or difference, which may arise in regard to the interpretation of these rules shall be determined by the Manager, whose decision shall be final and binding on all members.
